I recently ran across a news article publishing the names and arrest dates for four Colorado Springs men who were convicted of Solicitation for Prostitution. The article stated that an initiative was started in January of 2015 to publish the name and photos of people convicted of Soliciting for Prostitution, making it easily available to the public. Apparently, the Colorado Springs Police Department hopes that publishing this information will help deter people from participating in commercial sex acts.  In reality, it is almost like this police department has taken it upon themselves to create their own little registry that parallels itself to the sex offender registry. The idea behind the sex offender registry is for public safety. I guess the idea behind this initiative is for public embarrassment and how unfair is that? People make mistakes and instead of allowing them to move on, it will always be floating out there on the Internet.

The Colorado law definition of Prostitution – C.R.S. 18-7-201 – is:

Any person who performs or offers or agrees to perform any act of sexual intercourse, fellatio, cunnilingus, masturbation, or anal intercourse with any person not his spouse in exchange for money or other thing of value commits prostitution.

I think it is interesting to note that those convicted of Prostitution are not being publicly shamed with their name and picture released, only those convicted of (or arrested for in some cases) Soliciting for Prostitution. What is the thinking behind that? I’m sure many of the people convicted of Solicitation were caught in a police sting, but not all. With some of the cases, there are prostitutes involved. I wonder why they do not get the same humiliating treatment. Don’t get me wrong, I do not condone any illegal behavior. I just don’t think a person needs to be shamed for making that mistake in order to make a point to others.

Larimer County Soliciting for Prostitution Attorney | What is the Definition of Solicitation?

The Colorado law definition of Soliciting for Prostitution or Solicitation – C.R.S. 18-7-202 – is:

A person commits soliciting for prostitution if he:

  1. Solicits another for the purpose of prostitution; or
  2. Arranges or offers to arrange a meeting of persons for the purpose of prostitution; or
  3. Directs another to a place knowing such direction is for the purpose of prostitution.

As a class 3 misdemeanor, Solicitation is punishable by up to 6 months in the Larimer County Jail and $750 in fines. Class 3 misdemeanor is the lowest level misdemeanor crime a person can be charged with.
