Public Indecency is charged in Fort Collins and Larimer County when a person is accused of exposing themselves to cause alarm to another. A man was recently charged with a slew of crimes, including Public Indecency, after police say he exposed his genitals before running away. According to the report, someone contacted law enforcement to report a man was throwing tools out of a tow truck. Police arrived at the tow truck parking lot and made contact with the man after he was seen driving the tow truck through the lot. He apparently didn’t appreciate the officer’s presence, because swore at the officers, flashed his genitals and went into a field. Apparently, the man had broken into the tow truck business, took multiple keys to the trucks and began to cause damage. He caused over $28,000 in damages and is facing Burglary, Criminal Mischief, Obstructing an Officer, and Public Indecency.
Larimer County Public Indecency Attorney: Definition of Public Indecency in Colorado – Flashed Genitals
The Larimer County, Colorado law definition of Public Indecency – C.R.S. 18-7-301 – is:
(a) An act of sexual intercourse; or
(b) (Deleted by amendment, L. 2010, (HB 10-1334), ch. 359, p. 1707, § 1, effective August 11, 2010.)
(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or
(d) A lewd fondling or caress of the body of another person; or
(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.
The man was likely charged under subsection (e). Intent in important here. Public Indecency is charged when the intent of the exposure is just to upset someone. If there is any indication that the intent is for sexual gratification, then the more serious Indecent Exposure is charged, which is a sex offense.
