Man in Jail for a Public Indecency Petty Offense Picks Up a Felony Charge

Public Indecency is charged in Fort Collins and Larimer County, Colorado when a person is accused of a number of lewd activities. A man was recently being held in the Larimer County Jail for this offense, but while there he made things much worse for himself. When a deputy opened the man’s cell door to give him his food, the man started punching the deputy. Now, instead of the misdemeanor and petty offense charge he was facing, he has also been charged with felony 2nd Degree Assault on a Police Officer.

Larimer County Public Indecency Lawyer: Definition of Public Indecency in Colorado

The Larimer County, Colorado law definition of Public Indecency – C.R.S. 18-7-301 – is:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

While it did not disclose which subsection the man was charged under, it’s important to note that Public Indecency is very closely related to Indecent Exposure. Many of subsections are similar in nature, but Indecent Exposure is considered more serious and a sex offense.

Sentence for Public Indecency Petty Offense in Loveland and Estes Park

In Fort Collins, Loveland, and Estes Park, Public Indecency is a petty offense. This is a new modification to the law. Previously, a person could face a class 1 misdemeanor Public Indecency charge if certain aggravators applied. As of March 1, 2022, Public Indecency can only be charged as a petty offense.
