Man Caught Peeing on Building Mid-Stream

A man was caught peeing on a building by police officers while they were looking for him for a DV incident. Now he is facing Public Indecency charges as well.

Public Indecency is charged in Fort Collins and Larimer County when a person exposes themselves and the exposure causes distress to any other person. A man recently was charged with this crime, after cops encountered him peeing on a building. According to the report, the man had been accused of pushing his girlfriend down and punching her in the chest. When police arrived on scene, they found the man behind the building, peeing on it. So, not only was the man arrested for the Domestic Violence incident, he also got charged with Public Indecency.

Fort Collins Public Indecency Attorney: Definition of Public Indecency – Peeing in Public

The Larimer County, Colorado law definition of Public Indecency – C.R.S. 18-7-301 – is:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(b) (Deleted by amendment, L. 2010, (HB 10-1334), ch. 359, p. 1707, § 1, effective August 11, 2010.)

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

When peeing is involved, it is usually charged under subsection (e). If there was an allegation that the person exposed their genitals and it was not relieve themselves, but for a sexual purpose, then it would be the more serious charge of Indecent Exposure.

In Fort Collins, Loveland, and Estes Park, Public Indecency is a class 1 petty offense. However, if it is a charge under subsection (e), like it would be for the man above, and it is a second or subsequent offense, then it is charged as a class 1 misdemeanor.
