In Fort Collins and Larimer County, Public Indecency is charged for a few different circumstances, but one of those includes fondling the body of another person. Recently, at an amusement park haunted house, a couple was caught having a little too much fun and it resulted in criminal charges. According to the article, a teenager saw a man and woman together at the park and the woman had her hand in the man’s pants caressing his crotch. The teenager, being a teen, took a video of the instance and shared it with law enforcement. If this had occurred in Colorado, the woman could be facing charges for Public Indecency for her part in the act. They might also both be charged with Indecent Exposure for participating in an act of masturbation in public.

Larimer County Public Indecency Lawyer: Definition of Haunted House Public Indecency in Colorado

The Larimer County, Colorado law definition of Public Indecency – C.R.S. 18-7-301 – is:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(b) (Deleted by amendment, L. 2010, (HB 10-1334), ch. 359, p. 1707, § 1, effective August 11, 2010.)

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

As explained above, it’s likely the woman could be charged under subsection (d) because it seems that she was obviously caressing her boyfriend’s body, but there was no exposure of any of those body parts.

In Fort Collins, Loveland and Estes Park, Public Indecency is a petty offense. This charge is punishable by up to 10 days in the Larimer County Jail and up to $300 in fines. Previously, there were provisions that could make this crime a misdemeanor and require registration as a sex offender.
