Uber Driver Refuses to Let Passengers Out!

Taking and moving a person without their consent is charged as Second Degree Kidnapping in Fort Collins and Larimer County. An Uber driver was recently charged with multiple counts of this crime after his Halloween escapades, ending in a police chase. According to the report, four people were victims of the man’s Kidnapping spree. The first man who ordered the Uber ride, got in the car and the driver began to drive in the opposite direction of where the man wanted to go. The driver refused to stop and let the man out, so the passenger jumped out of the car. A woman had a similar story resulting in the same daring escape from the vehicle. Finally, two passengers were in the car when the police got involved. The driver led the police on a chase, and the passengers eventually jumped out during the chase. No information has been provided on why the man was behaving this way, but he was arrested for the Kidnappings.

Fort Collins Second Degree Kidnapping: Definition of Uber Kidnappings

The Fort Collins and Larimer County, Colorado law definition of Second Degree Kidnapping – C.R.S. 18-3-302 – is:

(1) Any person who knowingly seizes and carries any person from one place to another, without his consent and without lawful justification, commits second degree kidnapping.

(2)  Any person who takes, entices, or decoys away any child not his own under the age of eighteen years with intent to keep or conceal the child from his parent or guardian or with intent to sell, trade, or barter such child for consideration commits second degree kidnapping.

The man would have faced the charges under subsection (1) if this had occurred in Fort Collins, Loveland, or Estes Park.

Sentence for 2nd Degree Kidnapping in Larimer and Boulder County

Second Degree Kidnapping is a class 2, class 3 or class 4 felony depending on the circumstances. It is a class 2 felony if:

  • The person kidnapped is a victim of a sexual offense; or
  • The person kidnapped is a victim of a robbery.

It is a class 3 felony if:

  • The kidnapping is accomplished with intent to collect ransom; or
  • A deadly weapon is involved.

Second degree kidnapping is a class 4 felony if none of the above aggravators exist. The class 4 felony is likely what the Uber driver would be facing.
