Recently, a Greeley man was arrested and charged with Second Degree Trespassing after he violated a protection order and showed up at his dad’s home. According to the report, the father called police to report that his son was on the premises and was not supposed to be there. When police arrived, they located the man hiding in the shed. Upon trying to arrest him, the man acted out and ended up additional charges for Assault, Violation of a Protection Order, Resisting Arrest and Criminal Mischief.

The Colorado law definition of Second Degree Criminal Trespassing – C.R.S. 18-4-503 – is:

A person commits the crime of second degree criminal trespass if such person:

(a) Unlawfully enters or remains in or upon the premises of another which are enclosed in a manner designed to exclude intruders or are fenced; or

(b) Knowingly and unlawfully enters or remains in or upon the common areas of a hotel, motel, condominium, or apartment building; or

(c) Knowingly and unlawfully enters or remains in a motor vehicle of another.

Most often, when the Trespassing occurs on someone’s property (meaning outside or in outdoor buildings like a shed), then it is charged as Second Degree Trespassing.  Especially when there is a protection order in place, prohibiting someone from being in a certain location.

In Fort Collins, Loveland, and Estes Park, Second Degree Trespassing is a class 2 misdemeanor. It can, however, be aggravated to a class 4 felony if the land is considered agricultural land and there is an intent to commit a felony while Trespassing.
