Colorado Law on Public Indecency, C.R.S. 18-7-301 at the Larimer County Courts

As it is applied at the Larimer County Courts, Colorado’s law on Public Indecency, C.R.S. 18-7-301, is:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

What Acts Count as “Exposure” in Public Indecency Cases in Fort Collins, CO?

Colorado’s Public Indecency law prohibits several acts of exposure and sexuality in Fort Collins, CO.  Subsections (1)(c) and (1)(e) both prohibit exposing intimate parts or genitals, depending on the intent.  “Intimate parts” are defined as “the external genitalia or the perineum or the anus or the buttocks or the pubes or the breast of any person.”  This means that you could be charged with Public Indecency for exposing:

Any intimate part besides genitals with the intent to arouse another person (e.g., a woman suddenly pulling off her top to try to arouse a man walking by), or

  • Genitals under circumstances that could freak another person out (e.g., urinating on the side of a public business).

Breastfeeding is one important exception to Colorado’s Public Indecency law.  This is because there is no intent to sexually arouse another person.  Additionally, C.R.S. 25-6-302 protects women from having to cover up in public while breastfeeding, stating that “a mother may breast-feed in any place she has a right to be.”
