Indecent Exposure is charged in Fort Collins and Larimer County when a person exposes his or her private parts for sexual gratification or masturbates in view of another. A man is currently wanted for multiple counts of Indecent Exposure after he exposed himself and masturbated in public shortly after being released on bond for a similar case. According to the report, the man was in a park and exposed his genitals to one jogger and then was masturbating while riding a bike around another jogger. He was arrested for these incidents and released. Upon more investigation, he was identified as the person who also groped two women a month earlier. He is now wanted for the Unlawful Sexual Contact allegations.

The Colorado law definition of Indecent Exposure – C.R.S. 18-7-302 – is:

A person commits indecent exposure:

(a) If he or she knowingly exposes his or her genitals to the view of any person under circumstances in which such conduct is likely to cause affront or alarm to the other person with the intent to arouse or to satisfy the sexual desire of any person;

(b) If he or she knowingly performs an act of masturbation in a manner which exposes the act to the view of any person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

For the first incident, the man would likely have gotten two charges – one under each subsection for the exposing and masturbation with each jogger being named as the victim.

Sentence for Indecent Exposure in Loveland and Estes Park

In Fort Collins, Loveland, and Estes Park, Indecent Exposure is a class 1 misdemeanor sex offense. This level misdemeanor is punishable by 6 to 18 months in the Larimer County Jail and up to $5,000 in fines. A conviction for this offense would also require a person to register as a sex offender for a period of time. Also important to note: if this is a third or subsequent conviction for Indecent Exposure (or a similar crime from another state), then it is a class 6 felony charge.
