Indecent Exposure to a Child Charged as a Felony?

In Fort Collins and Larimer County, Indecent Exposure is generally charged as a class 1 misdemeanor. The only caveat to that is if it is a third or subsequent offense. Meaning, if the person charged already has two prior convictions for Indecent Exposure, then it is up charged to a class 6 felony. However, a new bill is being presented that would make another situation involving Indecent Exposure a felony crime – Indecent Exposure to a Child. The argument in support of the bill is that exposing yourself to a minor online is a felony charge (Internet Sexual Exploitation of a Child), so exposing yourself to a minor in person should be charged similarly. The bill proposes that the child would have to be under the age of fifteen and the actor must be four or more years older in order for the felony charge to apply.

Indecent Exposure to a Child in Larimer County: Colorado Law Definition of Indecent Exposure

The Larimer County, Colorado law definition of Indecent Exposure – C.R.S. 18-7-302 – is:

(1) A person commits indecent exposure:

(a) If he or she knowingly exposes his or her genitals to the view of any person under circumstances in which such conduct is likely to cause affront or alarm to the other person with the intent to arouse or to satisfy the sexual desire of any person;

(b) If he or she knowingly performs an act of masturbation in a manner which exposes the act to the view of any person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

It’s not clear in the article if there would be a new section of the definition, specifically addressing Indecent Exposure to a Child or if it will be an added section under the sentencing guidelines. It’s also not clear whether either of the acts listed under subsection (a) or (b) would apply, or if just one of the subsections would apply.

Current Sentence for Indecent Exposure in Loveland and Estes Park

As stated above, in Fort Collins, Loveland and Estes Park, Indecent Exposure is a class 1 misdemeanor. This level misdemeanor is punishable by up to 364 days in the Larimer County Jail. A person convicted of this crime will also have to register as a sex offender.
