We all know heavy traffic is aggravating. The HOV lanes some highways provide are a wonderful refuge from the stop and go highway annoyance, but only if you actually have more than one person in your car. A man from another state was using the HOV lane when he was pulled over for being the only one in his vehicle. When he was speaking to the police, he rolled down his back window to prove there were two other passengers in the car with him in the third row of his SUV. This would have solved the problem, except for the fact that the two men in the backseat were actually kidnapping victims and cried out for help when he rolled down the window. To get out of a small traffic violation ticket, the man risked outing himself and is now facing Kidnapping charges.

What is Kidnapping in Fort Collins?

Second Degree Kidnapping – C.R.S. 18-3-302 – is defined by Colorado law as:

Any person who knowingly seizes and carries any person from one place to another, without his consent and without lawful justification, commits second degree kidnapping.

According to the news report, the two victims had paid the man to drive them across the country and when they arrived, he demanded more money. When they wouldn’t pay, he took their phones, locked them in the car and took off with them. Because he moved the two victims from one place to another without their consent, he is facing 2nd Degree Kidnapping.

HOV Kidnapping: A Serious Offense

Having an experienced criminal defense lawyer on your side is imperative when facing Kidnapping charges.

This is the type of situation most people think of when they hear the word Kidnapping. Blatantly taking people against their will, locking them up somewhere and refusing to let them go. However, most of the Kidnapping cases we see are not that obvious. We have seen a father get charged for taking his kids out of state on vacation and violating a custody order. Or to stack the cards against our client, the district attorney charges Kidnapping because during a Burglary, the alleged burglar moved the homeowners to another room. No matter the circumstances, having an experienced criminal defense lawyer on your side is imperative when facing Kidnapping charges in Fort Collins, Loveland, or Estes Park.
