Woman Trying to Get Revenge on Her Ex Ends Up with Child Porn Charges

A woman was sentenced for Possession of Child Pornography after downloading the images to try and frame her husband as revenge.

Possessing child pornography is charged as Sexual Exploitation of Children in Fort Collins and Larimer County. A woman tried to use child pornography to get back at her husband, and instead she ended up with the felony charges. According to the report, the husband had kicked her out of the house and in an attempt to get back at him, she downloaded three child pornography images and took them to law enforcement. She claimed that the images were on her husband’s phone. She also made claims that he was having a sexual relationship with a teenager and that he assaulted her when she caught him. However, investigation showed that she was the one who downloaded the images. Even though it seems she had no sexual interest in the images, she was charged and sentenced for Possession of Child Pornography.

The Larimer and Boulder County, Colorado law definition of Sexual Exploitation of a Child – C.R.S. 18-6-403 – is:

(3) A person commits sexual exploitation of a child if, for any purpose, he or she knowingly:

(b.5)  Possesses or controls any sexually exploitative material for any purpose; except that this subsection (3)(b.5) does not apply to law enforcement personnel, defense counsel personnel, or court personnel in the performance of their official duties, nor does it apply to physicians, psychologists, therapists, or social workers, so long as such persons are licensed in the state of Colorado and the persons possess such materials in the course of a bona fide treatment or evaluation program at the treatment or evaluation site

The statute specifically states that you can be charged for possessing the images “for any purpose,” which means that possessing them for revenge would count.
