What is the BAC Level for Baby DUI in Fort Collins?
Colorado law defines the Blood Alcohol Content / BAC level for Baby DUI in Fort Collins as “at least 0.02 but not more than 0.05.” This is a much lower threshold than Driving While Ability Impaired / DWAI, where the BAC is between 0.51 and 0.79. The BAC for a Driving Under the Influence / DUI charge is 0.08 or greater.
While this threshold for being charged with Underage Drinking and Driving is much lower, it also means that a person’s first Baby DUI charge comes with much fewer penalties. Baby DUI is a class A traffic infraction – DUI and DWAI are unclassified misdemeanors – and is punishable by community service and mandatory alcohol education.
