When a man looked out his window and saw his daughter’s car being defiled, his decision to snap a photo may have led police to a ‘serial pooper.’ That’s right, this man was caught literally with his pants down, defecating on the hood of a woman’s car. Police claim 9 similar reports have been filed in that area, and are now wondering if the same man is creating all this disgusting havoc. Both the victim and her father did not recognize the man, and police believe pooping incidents may not be personal, just random.

Criminal Mischief in Larimer County

Colorado law defines C.R.S 18-4-501 – Criminal Mischief – as:

A person commits criminal mischief when he or she knowingly damages the real or personal property of one or more other persons, including property owned by the person jointly with another person or property owned by the person in which another person has a possessory or proprietary interest, in the course of a single criminal episode.

Much like the Theft statute, the amount of damage determines the level misdemeanor or felony charged in Larimer, Boulder, and Grand County. Criminal Mischief can be charged as a class 3 misdemeanor all the way up to a class 2 felony:

Class 1 Misdemeanor $750 to $999
Class 6 Felony $1,000 to $4,999

Class 3 Felony $100,000 to $999,999
Class 2 Felony $1,000,000 or more

While it has not been proven the man damaged more than the one car he was caught pooping on, if the police can connect him to the other incidents, the damage could really add up. Looking at the chart above, any damage totaling $1,000 or more becomes a felony. A felony on a criminal record can seriously affect a person’s future. Who knows if this was just a silly prank. Maybe it was just a step further than putting a burning bag of dog poop on someone’s front porch. Not that I am condoning that behavior, but does it warrant a felony charge?
