Posting a Private Image for Harassment, C.R.S. 18-7-107, is also known as “revenge porn” in Fort Collins and throughout Colorado.  This crime is charged when an adult, without the depicted person’s consent, posts a picture of another identifiable adult’s intimate parts or of the adult engaging in a sexual act.  The intent behind this act is to harass, intimidate, or coerce the depicted person, or it results in “serious emotional distress.”

Posting a Private Image for Harassment is a class 1 misdemeanor, but unlike other misdemeanors, it is punishable by a fine of up to $10,000.  You could also be sentenced to the Larimer County Jail for up to 364 days.

Loveland Posting a Private Image for Pecuniary Gain, C.R.S. 18-7-108

Similarly, Posting a Private Image for Pecuniary Gain, C.R.S. 18-7-108, is charged in Loveland for the same act as above – posting another adult’s nude photo without their consent.  The difference between this crime and Posting a Private Image for Harassment is the intent.  Posting a Private Image for Pecuniary Gain is charged when an adult posts another’s photo with the intent of making money off of it.  This offense is also a class 1 misdemeanor, with penalties including up to 364 days in the Larimer County Jail, a fine of up to $10,000, or both.

Posting a Private Image by a Juvenile, C.R.S. 18-7-109, is different from other private image offenses charged at the Larimer County Justice Center.  This is because it’s charged specifically when one juvenile posts a private image of another juvenile online or distributes another juvenile’s private image.  Posting a Private Image by a Juvenile is generally a class 2 misdemeanor, but can instead be a class 1 misdemeanor in some circumstances.
