Police were dispatched to a Colorado King Soopers last week when a call came in about a man running around the grocery store parking lot naked. When police arrived, the man was acting with ‘excited delirium’ and was naked from the waist down. He was arrested because the officers felt concern for the public’s safety. While the news article does not specify the charges he may be facing, probably at least one of them is Public Indecency
Naked in Public: What is Public Indecency in Fort Collins?
C.R.S. 18-7-301 – Public Indecency – is defined by Colorado law as:
(a) An act of sexual intercourse; or
(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or
(d) A lewd fondling or caress of the body of another person; or
(e) A knowing exposure of the person’s genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.
In Fort Collins, Loveland and Estes Park, a first offense Public Indecency conviction is a class 1 petty offense with a maximum jail sentence of 6 months and up $500 in fines. If it is a second offense, it becomes a class 1 misdemeanor and is considered a sex offense.
