The Larimer County, Colorado law definition First Degree Criminal Trespass – C.R.S. 18-4-502 – is:

A person commits the crime of first degree criminal trespass if such person:

(a) Knowingly and unlawfully enters or remains in a dwelling of another; or

(b) Enters any motor vehicle with intent to commit a crime therein.

Based on the information provided, the man would be charged under subsection (b) for entering the RV unlawfully and committing Theft (a crime therein).

Penalty for 1st Degree Trespassing in Fort Collins

In Fort Collins and Loveland, 1st Degree Trespassing is charged differently based on the subsection under which a person is charged. For a charge under subsection (a), it is a class 1 misdemeanor, but can be charged as a class 6 felony if the someone is in the dwelling when the Trespassing occurs. For a charge under subsection (b), it is a class 1 misdemeanor. A class 1 misdemeanor is punishable by up to 364 days in the Larimer County Jail. The sentencing range for the class 6 felony is 12 to 18 months in the Colorado Department of Corrections.
