Identity Theft in Fort Collins and Larimer County is charged when a person uses a credit or debit card that belongs to another person without their permission to obtain anything of value. A 7-Eleven employee is facing this felony charge after a woman accidentally left her debit card at the convenience store in Castle Rock. The store employee took the card and used it – spending over $900 plus $200 in overdraft fees. When the woman contacted the store, she immediately began to get texts from the employee trying to pay her off. Once police became involved, the employee was arrested after admitting to taking and using the card. Once he was released from jail, he again began to text and call the woman over and over again. At this point, the police had the phone and arrested the employee again, this time for Stalking and Violation of Bail Bond Conditions.

Larimer County Identity Theft Attorney: Definition of Identity Theft By 7-Eleven Employee in Boulder

The Larimer and Boulder County, Colorado law definition of Identity Theft as it relates to the case above – C.R.S. 18-5-902(1)(a) – is:

(1) A person commits identity theft if he or she:

(a) Knowingly uses the personal identifying information, financial identifying information, or financial device of another without permission or lawful authority with the intent to obtain cash, credit, property, services, or any other thing of value or to make a financial payment

Because the employee used the card to purchase services, like getting highlights in his hair, and goods, without permission from the card owner, he is facing this class 4 felony crime.
