New Law Regarding Ghost Gun – Unlawful Conduct Involving an Unserialized Firearm

In Fort Collins and Larimer County, there are many laws regarding firearms and weapons. A new bill was recently signed into law by our governor regarding Ghost Guns. A Ghost Gun is a gun that does not have a serial number. This would include guns that are 3D printed. Possession of these guns or gun components mean that the person was able to side step the background check and other procedures needed to own a firearm. The bill was signed into law on June 5, 2023.

Larimer County Unlawful Conduct Involving an Unserialized Firearm Colorado Law Definition: What is the Ghost Gun Law?

The Larimer County, Colorado law definition of Unlawful Conduct Involving an Unserialized Firearm, Frame, or Receiver – C.R.S. 18-12-111.5 – is:

(1)(a) A person shall not knowingly possess or transport an unfinished frame or receiver; except that it is not an offense if the unfinished frame or receiver is required by federal law to be imprinted with a serial number and has been imprinted with a serial number by a federal firearms licensee pursuant to federal law or subsection (7) of this section.

(2)(a) A person shall not knowingly sell, offer to sell, transfer, or purchase an unfinished frame or receiver; except that it is not an offense if the unfinished frame or receiver is required by federal law to be imprinted with a serial number and has been imprinted with a serial number by a federal firearms licensee pursuant to federal law or subsection (7) of this section.

(3)(a) A person shall not knowingly possess, purchase, transport, or receive a firearm or frame or received of a firearm that is not imprinted with a serial number by a federal firearms licensee authorized to imprint a serial number on a firearm, frame, or receiver.

(4)(a) A person shall not knowingly sell, offer to sell, or transfer a firearm or frame or receiver of a firearm that is not imprinted with a serial number by a federal firearms licensee authorized to imprint a serial number on a firearm.

(5)(a)(I) A person shall not manufacture or cause to be manufactured, including through the use of a three-dimensional printer, a frame or receiver of a firearm.

If you own a 3D printed gun, frame, or receiver of a firearm prior to the day the law was enacted, you have until January 1, 2024 to have the component imprinted with a serial number by a federal firearms licensee authorized to imprint a serial number on a firearm, frame, or receiver. This process will include the background check.

Sentence for Unlawful Conduct Involving an Unserialized Firearm, Frame or Receiver in Loveland and Estes Park

In Fort Collins, Loveland, and Estes Park, Unserialized Firearm, Frame or Receiver is a class 1 misdemeanor for a first offense. This level misdemeanor is punishable by up to 364 days in the Larimer County Jail and up to $1,000 in fines. If a person is charged with a second or subsequent offense, then the Ghost Gun law is charged as a class 5 felony, which is punishable by 1 to 3 years in the Colorado Department of Corrections and up to $100,000 in fines.
