Recently, a Colorado bill received some attention as it provided some clarity for prostitutes and sex workers. There is often a fear when someone is the victim of a crime that when they report the crime, they have to admit their part in breaking the law. For example, a man may want to call the police to report that his wife slashed his tires after they had an argument. However, during the argument, he pushed her out of his way so he could leave the room. He knows that when confronted, his wife will talk about the physical contact and may even exaggerate to gain some sympathy. Situations like this are not abnormal. For prostitutes, there was a stigma about reporting when they are treated with violence or have non-consensual encounters because they will have to admit that they are also breaking the law. This bill will make it so these sex workers to have immunity for the prostitution so they feel safe reporting any violations.

Larimer County Prostitution Charges: Definition of Prostitution in Colorado

The Larimer County, Colorado law definition of Prostitution – C.R.S. 18-7-201 – is:

Any person who performs or offers or agrees to perform any act of sexual intercourse, fellatio, cunnilingus, masturbation, or anal intercourse with any person not his spouse in exchange for money or other thing of value commits prostitution.

Sentence for Prostitution / Sex Workers in Loveland and Estes Park

In Fort Collins, Loveland, and Estes Park, Prostitution is a petty offense. As of March 1, 2022, a petty offense is punishable by up to 10 days in the Larimer County Jail and up to $300 in fines. However, if the bill above passes, this would not apply to someone reporting a crime while engaged as a sex worker.
