Colorado’s law on Invasion of Privacy for Sexual Gratification, C.R.S. 18-3-405.6, as it is used at the Larimer County Courts, is as follows:

A person who knowingly observes or takes a photograph of another person’s intimate parts without that person’s consent, in a situation where the person observed or photographed has a reasonable expectation of privacy, for the purpose of the observer’s own sexual gratification, commits unlawful invasion of privacy for sexual gratification.

Invasion of Privacy for Sexual Gratification is similar to Criminal Invasion of Privacy, C.R.S. 18-7-801.  There are two large differences between these two crimes:

Intent – Invasion of Privacy for Sexual Gratification involves observing another’s intimate parts without consent in a place where the person reasonably expects privacy to fulfill your own sexual gratification.  Criminal Invasion of Privacy involves the same elements except the intent to gain sexual satisfaction.

Penalties – Invasion of Privacy for Sexual Gratification is generally a more severe charge, given that it is charged as a class 1 misdemeanor or class 6 felony.  It also requires registration on the Colorado Sex Offender Registry.  Criminal Invasion of Privacy is a class 2 misdemeanor and does not require sex offender registration.
