A man from another state decided to take advantage of his neighbor’s vacation. While they were away, he decided to go furniture shopping at his neighbor’s place, allegedly taking their love seat, chair and other belongings. He left his old recliner and TV stand in their place. What is the Punishment for Burglary in Fort Collins and Loveland?
Second Degree Burglary is a class 4 felony, but it is a class 3 felony if:
- It is a burglary of a dwelling; or
- It is a burglary, the objective of which is the theft of a controlled substance, as defined in section 18-18-102 (5), lawfully kept within any building or occupied structure.
In the case above, the man would be charged with a class 3 felony, because it was an alleged Burglary of a dwelling.
